Draft Amendments to the Tamil Nadu Motor Vehicles Rules.
(G.O. Ms. No. 548, Home (Transport-VII), 1st December 2021, mime 15, Slow, geving -2052. No. SRO A-24/2021-The following draft amendments to the Tamil Nadu Motor Vehicles Rules, 1989 which are proposed to be made in exercise of the powers conferred by sections 28 and 38 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) is hereby published for the information of all persons likely to be affected thereby, as required under sub-section (1) of Section 212 of the said Act.
2 Notice is hereby given that the draft amendment will be taken into consideration on or after the expiry of thirty days from the date of publication of this Notification in the Tamil Nadu Government Gazette and that any objection or suggestion, which may be received from any person with respect thereto before the date of expiry of the aforesaid period will be considered by the Government of Tamil Nadu.
3. Objection or suggestion, if any, should be addressed in duplicate to the Additional Chief Secretary to Goverment,
Home, Prohibition and Excise Department, Secretariat, Chennai-600 009.
DRAFT AMENDMENTS
In the said Rules (1) in nule 38 for the side heading "Responsibility of driver of Stage Camiage on which there is no conductor, the side heading "Responsibility of driver when there is no conductor shall be substituted. 2 () in rule 79, after clause (iv), the following proviso shall be inserted there under, namely:
"Provided that if any male passenger travelling in the vehicle attempts or makes any obscene act, like, staring, leening,
whistling, winking or sexually offensive gestures or singing songs, utter words, take any photos or video's or any other form of electronic communication causing annoyance or harassment of a women passenger or girl indulging in any other form of misbehavior with intent to outrage the modesty of the women passengers travelling in the vehicle, the conductor may after the reasonable caution, either, alight the passenger or hand over him to any police station enroute." (i) after the clause (xi), the following clauses shall be inserted, namely:
(xii) shall not, save for good and sufficient reasons touch any women passenger or girl on the false pretext that he is assisting her to get into or getting down the vehicle.
(xiii) shall not ask any inappropriate questions about the intention of travel of a woman passenger or a girl travelling in the vehicle.
(xiv) shall not make any physical contact or any sexually coloured remarks or comments or jokes advancing towards woman passengers or girls involving unwelcome and explicit sexual overtures, such as touching or pinching to indicate indirectly his sexually suggestive innuendos, commonly understood as flirting
(xv) shall not behave in a way causing annoyance to any passengers, women passengers or girl in specific. (xvi) may remove any male passenger from the seat he occupies, and ask him to alight the vehicle. enroute, if he comes to know on a proper enquiry with other co-passengers that the passenger was involved with unwelcome and explicit sexual overtures as defined under the term "Sexual Harassment in clause (n) of Section 2 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013 (Central Act 14 of 2013)
(xvii) shall maintain a Complaint Book with serially numbered pages to be provided to any passenger for recording his views on the complaints about the shortage of the duties performed by the conductor and shall produce the so maintained books on demand by the Police Officials or the Officials of the Transport Department for the review.
(xviii) shall take the vehicle to a police station which is nearest to the place of incidence and lodge a complaint against the passenger in case of an incident of indecent behaviour, molestation or eve-teasing, etc., against a woman passenger girl travelling in the vehicle by any co-passenger which is tantamount t outraging her - desty. தமிழ்நாடு மோட்டார் வாகன விதிகளில் வரைவு திருத்தங்கள்.

SRO A-24/2021- மோட்டார் வாகனச் சட்டம், 1988 (மத்திய சட்டம் 59) பிரிவுகள் 28 மற்றும் 38 மூலம் வழங்கப்பட்ட அதிகாரங்களைப் பயன்படுத்தி, தமிழ்நாடு மோட்டார் வாகன விதிகள், 1989 இல் பின்வரும் வரைவு திருத்தங்கள் செய்ய முன்மொழியப்பட்டுள்ளன. 1988 ஆம் ஆண்டு) மேற்படி சட்டத்தின் பிரிவு 212 இன் துணைப்பிரிவு (1)ன் கீழ் தேவைப்படும், அதனால் பாதிக்கப்படக்கூடிய அனைத்து நபர்களின் தகவலுக்காக இதன் மூலம் வெளியிடப்படுகிறது.
2 தமிழ்நாடு அரசிதழில் இந்த அறிவிப்பு வெளியிடப்பட்ட நாளிலிருந்து முப்பது நாட்கள் முடிவடைந்தவுடன் வரைவு திருத்தம் பரிசீலனைக்கு எடுத்துக் கொள்ளப்படும் என்றும், எந்தவொரு ஆட்சேபனை அல்லது ஆலோசனையும், எந்தவொரு நபரிடமிருந்தும் பெறப்படலாம் என்றும் இதன் மூலம் அறிவிக்கப்பட்டுள்ளது. மேற்கூறிய காலக்கெடு முடிவடையும் தேதிக்கு முன் அது குறித்து தமிழக அரசு பரிசீலிக்கும்.
3. ஆட்சேபனை அல்லது ஆலோசனை, ஏதேனும் இருந்தால், அரசாங்கத்தின் கூடுதல் தலைமைச் செயலருக்கு நகல் அனுப்பப்பட வேண்டும்.

வரைவு திருத்தங்கள்
மேற்கூறிய விதிகளில், (1) எண் 38ல் உள்ள "கண்டக்டர் இல்லாத ஸ்டேஜ் கேமியேஜ் ஓட்டுநரின் பொறுப்பு, நடத்துனர் இல்லாத போது ஓட்டுநரின் பொறுப்பு" என்ற பக்க தலைப்புக்கு பதிலாக மாற்றப்படும். 2 () விதி 79 இல், உட்பிரிவு (iv) க்குப் பிறகு, பின்வரும் நிபந்தனை அங்கு செருகப்படும், அதாவது:
"வாகனத்தில் பயணிக்கும் எந்தவொரு ஆண் பயணியும் உற்றுப் பார்ப்பது, குனிவது போன்ற ஏதேனும் ஆபாசமான செயலை முயற்சித்தால் அல்லது செய்தால், விசில் அடித்தல், கண் சிமிட்டுதல் அல்லது பாலியல் ரீதியாக புண்படுத்தும் சைகைகள் அல்லது பாடல்களைப் பாடுதல், வார்த்தைகளை உச்சரித்தல், புகைப்படங்கள் அல்லது வீடியோக்கள் அல்லது வேறு எந்த வடிவத்திலும் ஒரு பெண் பயணி அல்லது சிறுமிக்கு எரிச்சல் அல்லது துன்புறுத்தலை ஏற்படுத்தும் மின்னணு தொடர்பு வாகனத்தில் பயணிக்கும் பெண் பயணிகளின் கண்ணியத்தை சீற்றம் செய்யும் நோக்கில் தவறான நடத்தை, நடத்துனர் பின்வாங்கலாம்
நியாயமான முன்னெச்சரிக்கையுடன், பயணிகளை இறக்கிவிடவும் அல்லது வழியில் ஏதேனும் காவல் நிலையத்தில் ஒப்படைக்கவும்." (i) உட்பிரிவு (xi) க்குப் பிறகு, பின்வரும் உட்பிரிவுகள் சேர்க்கப்படும், அதாவது:
(xii) நல்ல மற்றும் போதுமான காரணங்களுக்காக, வாகனத்தில் ஏறவோ அல்லது இறங்கவோ உதவி செய்கிறார் என்ற தவறான சாக்குப்போக்கில், எந்தவொரு பெண் பயணிகளையும் அல்லது சிறுமியையும் தொடக்கூடாது.
(xiii) ஒரு பெண் பயணி அல்லது வாகனத்தில் பயணிக்கும் சிறுமியின் பயணத்தின் நோக்கம் குறித்து பொருத்தமற்ற கேள்விகள் எதையும் கேட்கக்கூடாது.
(xiv) பொதுவாக ஊர்சுற்றுவது எனப் புரிந்து கொள்ளப்படும், மறைமுகமாகத் தொடுதல் அல்லது கிள்ளுதல் போன்ற விரும்பத்தகாத மற்றும் வெளிப்படையான பாலியல் உணர்வுகளை உள்ளடக்கிய பெண் பயணிகள் அல்லது சிறுமிகளை நோக்கி எந்தவிதமான உடல் ரீதியான தொடர்பு அல்லது பாலியல் வண்ண கருத்துக்கள் அல்லது கருத்துகள் அல்லது நகைச்சுவைகளை செய்யக்கூடாது.
(xv) எந்தவொரு பயணிகளுக்கும், பெண் பயணிகளுக்கும் அல்லது குறிப்பிட்ட சிறுமிக்கும் எரிச்சலை ஏற்படுத்தும் வகையில் நடந்து கொள்ளக்கூடாது.
(xvi) எந்த ஆண் பயணியையும் அவர் அமர்ந்திருக்கும் இருக்கையில் இருந்து அகற்றி, அவரை வாகனத்தில் இருந்து இறங்கச் சொல்லலாம். வழியில், பணியிடத்தில் பெண்களுக்கு ஏற்படும் பாலியல் துன்புறுத்தல் பிரிவு 2 இன் பிரிவு (n) இன் பாலியல் துன்புறுத்தல் என்ற வார்த்தையின் கீழ் வரையறுக்கப்பட்டுள்ளபடி, மற்ற சக பயணிகளிடம் முறையான விசாரணையில், பயணி விரும்பத்தகாத மற்றும் வெளிப்படையான பாலியல் வெளிப்பாடுகளில் ஈடுபட்டுள்ளார் என்று அவருக்குத் தெரிந்தால். (தடுப்பு, தடை மற்றும் தீர்வு) சட்டம், 2013 (மத்திய சட்டம் 14 இன் 2013)
(xvii) பதிவு செய்வதற்காக எந்தவொரு பயணிக்கும் வழங்கப்பட வரிசையாக எண்ணிடப்பட்ட பக்கங்களைக் கொண்ட புகார் புத்தகத்தை பராமரிக்க வேண்டும்.
நடத்துனர் செய்த கடமைகளின் பற்றாக்குறை பற்றிய புகார்கள் மீதான அவரது கருத்துக்கள் மற்றும் அவ்வாறு பராமரிக்கப்படும்
மறுஆய்வுக்காக காவல்துறை அதிகாரிகள் அல்லது போக்குவரத்து துறை அதிகாரிகளின் தேவைக்கேற்ப புத்தகங்கள்.
(xviii) பயணிக்கும் பெண் பயணிகளுக்கு எதிராக அநாகரீகமான நடத்தை, மானபங்கம் அல்லது ஈவ்-டீசிங் போன்ற ஒரு சம்பவம் நடந்தால், சம்பவ இடத்திற்கு அருகில் உள்ள காவல் நிலையத்திற்கு வாகனத்தை எடுத்துச் சென்று, பயணிக்கு எதிராக புகார் அளிக்க வேண்டும். வாகனத்தில் எந்த சக பயணிகளும் அவளை சீற்றத்திற்கு சமம் - அவலட்சணம்
பேருந்தில் பயணம் செய்யும் ஆண் பயணிகள், பெண் பயணிகளிடம் தவறாக நடக்க முற்பட்டால் பேருந்தில் இருந்து இறக்கி விடவும், போலிசாரிடம் புகார் அளிக்கவும், ஒட்டுநர் மற்றும் நடத்துநருக்கு அனுமதி.
